Introduction:

Each year the 16 Days of Activism campaign has provided a rallying point for the governments, NGOs, CBOs and other stakeholders in the country to mount events aimed at raising awareness, influencing behavior change and securing high level of political commitment to end violence against women(VAW). So, different women organizations and activists have been celebrating 16 days of activism as an International Day to end "Violence against Women" on 25th November since 21 years. This day was chosen to commemorate the death of three Mirabel sisters, Patria, Maria and Antonia, who were detained, tortured and assassinated in 1960 during the dictatorship of Trujillo in the Dominic Republic. This incident can be taken as the political violence based on gender discrimination. So, the feminists from all over the world started to celebrate the day of their assassination as Day on "Violence against Women". Later on it was officially recognized by United Nations and established it as an International Day on elimination of all forms of "Violence against Women".

16 days of activism celebration is more significant unlike other International celebrations since this celebration to end VAW is not limited to a single day. It is also important as a platform being used by women activists all over the world to call for the elimination of all forms of VAW and advocate for women’s right to live in equality. Every year it is celebrated from 25th November till 10th December (International Human Rights Day) by organizing different awareness raising programs. This year also WOREC Nepal is organizing different programs from community level to National level in solidarity to eliminate VAW all over the world like previous years. The main objective of celebrating this activism is to acknowledge and institutionalize the achievements accomplished in the past by organizing different programs from the perspectives of women's liberation and the commitment to end VAW.

 

Present Status:

The primary step to create the environment for the elimination of VAW is the establishment of sustainable peace in the country. And the establishment of sustainable peace is possible only when there is gender friendly constitution in the country. Gender Friendly constitution is not possible without ending the trend of militarization within the political parties and pulling each other's legs. Analyzing the present context, the deadlock condition of the country will not easily end up due to the political instability and irresponsible behavior seen within the political parties. Due to this, the democracy brought by the efforts of thousands of people including mothers who lost their womb, wives who lost their husbands and those who were disabled, is on a verge of collapse now. In such context, speeding up of 16 days campaign to eliminate VAW is imperative in order to make the stakeholders and duty bearers aware, and strengthen the capacity of right holders to be able to claim their rights.

 

In previous year (2011)," 100 days Campaign on Violence against Women for Zero Tolerance" was conducted on the leadership of Women Human Right Defenders in all the 75 districts. The campaign was conducted with two demands i.e. the mechanism to address complaints registered by the victims of violence within 24 hours should be developed and there should be a policy for the "Security of Women Human Rights Defenders". During the campaign on 2068/11/11, Prime Minister Dr. Baburam Bhattarai in inter-ministerial meeting opined that violence on women is an insult to the country; and he directed the Secretary of Ministerial office and Security agency to make short and long term plans to organize campaigns and also directed concerned authorities to address the complaint within 24 hours of registration. Despite of this, women were unable to get proper justice. It is evident that the security personal of high position murdered his wife. Thus it is obvious that women from every sector including housewives, laborers, women in media, women who are involved in politics are also victimized. But still, there is not a single example where the incident of violence against women was addressed within 24 hours. Though Prime Minister personally commanded to respond for the incident it is not being implemented which arise a question on trust and accountability of the government. And we also opined that this situation has arisen due to the militarism existing in political parties, unequal power relationship and patriarchy.

This year, 152 women were killed, 211 women were raped, 12 committed suicide, 23 women were raped by family members and 75 women were alleged as witch.[1] Despite of such increasing number of cases on VAW, there are very rare cases where the victims succeeded to get justice. Such situation is not acceptable for any Nepalese who struggled to establish democracy in Nepal. So, we all should enroll ourselves and request all to participate in the campaign "Establish Peace from our home to world by challenging Militarism".

Referring to the reality of Nepalese society with intrinsic social patriarchal system fueling for gender disparity and gender violence against women, and current political situation in Nepal, this year WOREC Nepal has formulated its slogan as follows : "Peace to end Violence against Women: Constitution for peace building and our Collaboration to make Political Parties Responsible for Constitution making!"So, we request all the Nepalese to show their commitment in our attempt to transform this slogan into reality.

 

Analysis:

Based on study, researches and experiences of women right activists, it can be stated that until and unless there is existence of the trend of militarism and persisting patriarchy nourished by militarism in the ruling government, political parties and other responsible security personals, neither democracy will be strong nor VAW will be eliminated. So, Nepal is in verge of both opportunity as well as challenges today. On one hand with the collective effort of civil society, Human Right Activists, other democratic forces and political parties challenged to eliminate the previously established patriarchal militarism, which creates opportunity to establish the egalitarian society; and on the other hand, the people with traditional and persisting practice of patriarchal militarism might jeopardize the achievements made after long struggle although they have verbal commitment to democracy and social justice. There is increasing risk due to rigidity of political parties, militarist trend and patriarchal concern. This situation is challenging those who are working to eliminate VAW. Internalizing this situation also, women right activists are relentlessly campaigning on "Violence against Women". After the Comprehensive Peace Agreement and commitment to establish peace in the country, the government is also conducting different programs named "Zero Tolerance on Violence against Women". Such programs are reflected as compensatory process; however, this could not bring any significant change in women's life and situation. Obviously, everyone should think seriously about the reason behind this happening.

The women activists through their experiences from community level to national level have found that the "Militarist patriarchal trend" still exists in the mentality of people at all levels and also opined that this is due to the globalization of open market economy. Until and unless the country is liberated in real sense, the political parties free themselves from corruption and become active for the country and people, the change cannot occur. The country will be continuously directed and controlled by different power centre; and the ongoing peace process will never be concluded.

The search of peace would not be possible only through army integration. It will be possible only after the elimination of Militarism trend, by addressing grievances armed conflict and translating consensus of political parties and their honest commitment into practice. It is impossible to address this situation without coordination and pressure for "Agreement between political parties and their commitment to implement the agreement in practice". Thus WOREC Nepal has forwarded the slogan "Peace to end violence against women: Constitution for peace building and our collaboration to make Political Parties Responsible for Constitution making!!. With this slogan, WOREC Nepal will organize different programs during the period of the 16 days activism.

Objectives: The main objectives of the 16 days of activism are as follows:

  • To exert pressure for political commitment to end violence against women.
  • To create awareness among common people for ending violence against women.
  • To launch "Anbeshi" an analytical report on VAW and make concerned stakeholders responsible for ending VAW by presenting the year book as a proof.
  • To mention everyone about the role and importance of Women Human Right Defenders (WHRDs) and to do advocacy for their identity and security.
  • To initiate for the solidarity of civil society to exert pressure for promulgation of constitution and conclude peace process.

  • The annual report on violence against women "Anbeshi" (July 2011 to June 2012) will be launched along with the analysis of incident.
  • The declaration, national action plan, programs on gender based violence announced by the government will be disseminated all over the country.
  • Advocacy for the national and International recognition of Women Human Right Defenders (WHRDs) will be landed.
  • The basis to continue 100 days campaign on violence against women will be prepared.
  • Opinions from people of different sectors will be collected, which will help to create a favorable environment to pressurize for new constitution making.

बलात्कार विरुद्ध राष्ट्रिय अभियान

पछिल्लो समयमा देशभर बढ्दै गएका बलात्कारका घटनाले हरेक संवेदनशील व्यक्तिको शिर निहुरेको छ । ओरेक नेपालको तथ्याङ्कलाई मात्रै आधार माने पनि गत तीन महिनामा मात्र १४९ जना महिलाहरू बलात्कृत भएका थिए, १४ जनामाथि बलात्कारको प्रयास भएको  थियो  । यसरी बलात्कृत भएका  महिलामा विशेषत; दलित, गरिव, एकल महिला एवम् बालिकाहरू रहेका छन् । यो स्थितिले  हाम्रो देश अहिले कुन दिशामा जाँदै छ भन्ने तीतो यथार्थलाई प्रस्ट पार्दछ । न्याय, समानता र आत्मसम्मानको लागि भनि सबै नेपालीको सहभागितामा भएको ६२÷६३ को सफल आन्दोलनपछिको स्थितिमा देशमा महिलाको स्थिति यस्तो देखिनु भन्दा पीडादायी अरु के हुन सक्ला ? यसमा थप पीडा यसरी पीडित भएका महिलाहरूको न्यायमा पहुँच सुनिश्चित हुन नसकेको स्थितिले दिएको छ । देशमा बलात्कार सम्बन्धी कानुन विभेदकारी छ ! त्यसमा, कसैले बलात्कार गर्दा कम सजाय हुने र कसैले गर्दा बढी सजाय हुने मान्यता राखिएको छ । उदाहरणका लागि अहिलेको बलात्कार सम्बन्धी कानुनका प्रावधानहरू यस्ता छन् ः १० वर्षभन्दा मुनिका बालिकालाई बलात्कार गरेमा १० देखि १५ बर्षसम्म कैद, १४ बर्षदेखि १६ बर्षसम्मका बालिका वा किशोरीलाई बलात्कार गरेमा ८ देखि १२ वर्षसम्म कैद, १६ देखि २० बर्षसम्मको युवतीलाई बलात्कार गरेमा ५ देखि ८ वर्षसम्म कैद र २० वर्षदेखि माथिका महिलाहरूलाई बलात्कार गरेमा ५ देखि ७ बर्षसम्म कैद सजायको ब्यवस्था गरिएको छ ।  त्यस्तै गरी बलात्कारको उजुरीका लागि ३५ दिने हदम्याद तोकिएको छ ! प्रमाणका आधारहरू मानिने  प्रावधानहरू  विभेदकारी र प्रभावहीन छन् । यसप्रकारको विभेदपूर्ण कानुनी प्रावधान रहेको स्थितिमा प्रभावित महिलाले न्याय पाउन चुनौतीपुर्ण छ  । यस्ता विभेदकारी प्रावधानहरूका कारण बलात्कारीलाई भने अझ बढी बलात्कार गर्ने हौसला मिलेको छ कि भनि भन्ने आधार अहिले बढ्दै गएको बलात्कारका घटनाहरूले देखाउँछन् ।  

 

त्यसैगरी, हाल देशमा प्रचलित बलात्कार सम्बन्धी अनुसन्धान प्रक्रिया लामो र त्रुटीपूर्ण छ । त्यसमा थप  अदालती कारवाही, न्याय प्रहरी तथा प्रशासन क्षेत्रभित्रका केही व्यक्तिहरूमा रहेको पितृसत्तात्मक सोच, धारणा र व्यवहारले बलात्कार गर्ने व्यतिmलाई थप हौसला दिएको छ कि भन्ने भान हुन्छ । । देशमा स्थापित दण्डहीनताको संस्कृति, अपराधमा राजनीति जस्ता तत्वहरूले गर्दा बलात्कारीभित्र मैले जे गरे पनि हुन्छ, मलाई कसले के गर्न सक्दछ ? भन्ने अपराधिक मानसिकताको विकास भएको पाइन्छ । यो स्थिति कुनै पनि नेपालीको लागि सह्य छैन । त्यसकारण यो स्थितिको अन्त्य गर्न समुदायस्तरदेखि राष्ट्रियस्तरसम्मका सबै व्यक्तिहरू सबै तहमा “बलात्कार विरुद्ध राष्ट्रिय अभियान” मा एकबद्ध भई जुट्नु अनिवार्य भएको छ ।

यही अवस्थालाई ध्यानमा राखी गर्दै महिला मानव अधिकार रक्षकहरूको राष्ट्रिय सञ्जालको अगुवाईमा “अन्तर्राष्ट्रिय शान्ति दिवस” को अवसर पारी २२ सेप्टेम्बर (असोज ६ गते) का दिनदेखि मानव अधिकार दिवस १० डिसेम्बर २०१३ सम्म राष्ट्रिय रूपमा यो अभियान सञ्चालन गरिंदै छ । यो अभियानको आयोजक तथा सहयोगीका रूपमा सामेल हुन हामी हरेक संङ्घ संस्था र व्यक्तिहरूलाई हार्दिक अनुरोध गर्दछौ ।

अभियानको उद्घेश्य ः

बलात्कारका विरुद्धमा जनचेतना फैलाई बलात्कार नहुने वातावरण निर्माण तथा बलात्कार पीडित ÷ प्रभावितको सामाजिक, कानुनी न्यायको अधिकार सुनिश्चितताको आधार तयार गर्ने ।

अभियानका मागहरू ः

  • बलात्कार सम्बन्धी हालको कानुनमा (अध्यादेशबाट भए पनि) संशोधन गरियोस् ।
  • द्रुतन्याय प्रणाली (फाष्ट ट्रयाक कोर्ट) को गठन तथा हालका लागि अदालतले गरेको निरन्तर सुनुवाईको प्रक्रिया अवलम्बन गरी बलात्कारबाट प्रभावितहरू सबै घटनाको अविलम्ब प्रभावकारी फैसला गरियोस् ।
  • बलात्कार सम्बन्धी अनुसन्धान प्रक्रियालाई संवेदनशील र प्रभावकारी बनाउन नेपाल प्रहरीका लागि निर्देशिका निर्माण र कार्यान्वयन ।
  • बलात्कार तथा यौनशोषणबाट पीडित महिला बालिकाहरूको पढ्न पाउने, तथा स्वास्थ्य सेवा र न्यायपूर्ण वातावरणमा बस्न पाउने अधिकार CRCCEDAW माग गरिएको प्रतिवद्धता अनुरूप नीतिगत तवरबाट सुनिश्चित गरी त्यसका बजेटमा व्यवस्था १

CAMPAIGN ON VIOLENCE AGAINST WOMEN ALLEGING AS WITCHES

Context: Nepal a country emerging from armed conflict and with a strong base of patriarchy and feudalism at its roots, has institutionalized the norm of violence as portrayed in social values, political criminalization and impunity. The practice of routinely subjecting women to various forms of violence from womb to grave is pervasive. Lately the practice of alleging women as witches and brutalizing them mutilating them and even murdering them is in increase. Political elite of the country is busy negotiating for peace which for women is a very narrow concept. For political parties at present peace means reintegration of Maoist combatant into Nepal army. For and against group is fighting to make themselves heard and their agenda addressed. This situation has created the environment where marginalized community in general and women in particular are being victimized due to absence of security, rule of law, criminalization of politics and culture of impunity.

Long standing taboos and discriminatory traditional practices are being used in different areas to exercise power. Violence against women alleging them as witch can be taken as one among them. Struggle of women's group for women's right, facilitation to empowerment process of women by different development partners and 12 yrs long political conflict in country has impacted on women's empowerment. Now women are demanding their rights, became stronger than they used to be and silence which was within them on VAW started to get broken. But the system to address this is quite weak. In stead lack of rule of law, focus to ensure socio-economic rights of people and effort to address the discriminatory traditional harmful practices has created an environment for those who were in power in the past and feeling challenged by women at this moment to use this tool to silence them. This has been an issue raised by activist in the country and even CEDAW committee has recommended Government to address this by doing the followings"

The Committee recommends that the State party:

(a) Put in place without delay a comprehensive strategy, with concrete goals and

timetables, to eliminate patriarchal attitudes and stereotypes that discriminate against

women, in conformity with articles 2 (f) and 5 (a) of the Convention;

(b) Strengthen its awareness-raising and educational efforts, targeted at both women and men, with the involvement of civil society, as well as community and religious leaders, to eliminate harmful traditional practices, and collaborate with the media to enhance a positive, non-stereotypical and non-discriminatory portrayal of women; and

(c) Promptly enact the draft law on social harmful practices, ensure that it covers all forms of harmful practices and ensure full implementation of this law without delay as well as monitoring of its effective implementation.

 Introduction:

Violence against women alleging them as witches has been increased in country. In last 6 months more than 95 women (WOREC –report) have been abused in different districts due to this.  Various means and approaches have been taken by the community to punish women alleging them as witches. Degrading and inhuman practices such as forcing women to take human excreta, mutilating their body parts, blinding them, burning them alive are some of the examples. This is becoming a practice in country to silence women. This situation has been compounded with the abuse and isolation of women Human Right Defenders, who are the support mechanism for women in community, by the perpetrators of such inhuman behavior and abuse. This situation demands attention from all sectors and intervention to raise the issue, to address the need of survivors, educate the community and to create pressure on Government to develop effective action plan and implementation mechanism to address this. This is also in line with the recommendation given by the CEDAW committee in 49th session.

National Alliance of Women Human Right Defenders (National Network working for the rights of women Defenders is in all 75 districts in the country) has recently concluded 100 days campaign against VAW. The Experience of NAWHRD shows that the activities focused during campaign enables to make the issue visible, to disseminate the information about the support mechanism to the survivors and to create pressure on Government.

Need of the campaign focusing on violence against women alleging them witches has been felt by all Women. This is necessary to support women to resist the abuses and demand to address the need of survivor and for effective plan of action and implementation mechanism against this heinous crime by the Government.

Objective:

The objective of this campaign is as follow:

To bring all stake holders together by educating, informing, sensitizing from grassroots to national level( and even international) to act against this heinous crime against humanity, particularly against women and to ensure rights of the survivors to get justice and reparation.

Activities:

This National campaign will be launched for 60 days starting from April eleventh. This campaign will be launched primarily nationally however for this phase this will be focused IN FOLLOWING DISTRICTS:

Sirha, Saptari, Dhanusha, Mahottari, Sarlahi, Rautahat,Sindhuli chitwan( Madi), Makwanpur, Lalitpur and Kathmandu, The activities in Kathmandu will be of a National in NATURE.

Following activities will be part of this campaign:

  1. Launch of the campaign by WHRDs of above mentioned districts along with National alliance of WHRDs and other alliances in Kathmandu at Basantpur on 11th of April  Launch of the campaign in above mentioned districts on 13th Siraha Saptari 14th, Chitwan 15th, Sarlahi and Mahottari on 16th, Rautahat17th, Makwanpur 18th.
  2. National hearing of survivors with all policy makers May 2nd
  3. Interaction with Journalists specially from the districts where the program will be launched and in Kathmandu to prepare radio program, journalists will be encouraged to host radio program regularly.
  4. Preparation of attention letter to PM and government authorities and handing over to them by WHRDs from the districts.
  5. Communication with Special Rapporteur on VAW will be maintained and request to invite her to examine the cases will be put forward.
  6. Cases of women alleged as witches and abused in these districts and others will be documented

This will be a joint campaign of National Alliance of Women Human Right Defenders, NFORCE, Mahila Adhikar Manch,WOREC-Nepal, Care Nepal, Actionaid International Nepal and other organization interested to work together in this issue. The secretariat will be at NAWHRD secretariat, program will be implementation in leadership of NAWHRD secretariat in collaboration with other stakeholders mentioned above.

Out comes:

The practice of violence against women alleging them as witches is a result of women's status given in society, discriminating women by policy makers , existence and practice of harmful traditional practices so it is very difficult to get tangible outcome with this short term campaign oriented activities. However due to sensitive atmosphere and realization of multiple actors including the policy makers that this crime needs to be stopped and addressed following outcomes are envisaged by this campaign:

  1. Communities will be sensitized on women's right and be sensitive
  2.   There will be commitment by Top Brass of the country to prepare action Plan and implementation mechanism to address the crime.
  3. Compliance to the recommendation of the CEDAW committee will be increased.
  4. Law to address the crime will be adopted.
  5. Women survivors will get justice and couple of them will take the lead as change agents to address the crime( principle of self representation and practice of from victim hood to change agents will be practiced)
  6. Journalists will be sensitized and the issue will become more visible which in turn will enable women to break the silence and report incase they need.
  7. There will documented cases
  8. Communication with Special Rapporteur will be increased and there will be communication by UNSRVAW with Government in her report.
  9. The visibility of the issue will be increased and their will be a sensitive environment in the country to look at the issue and change harmful social and cultural practices.
  10. Large women network will start working together which will strengthen women's movement in Nepal.

"Initiation of World peace from Home: Let's end violence on women challenging militarization"

Introduction:

Each year the 16 Days of Activism campaign has provided a rallying point for the governments, NGOs, CBOs and other stakeholders in the country to mount events aimed at raising awareness, influencing behavior change and securing high level of political commitment to end violence against women(VAW). So, different women organizations and activists have been celebrating 16 days of activism as an International Day to end "Violence against Women" on 25th November since 21 years. This day was chosen to commemorate the death of three Mirabel sisters, Patria, Maria and Antonia, who were detained, tortured and assassinated in 1960 during the dictatorship of Trujillo in the Dominic Republic. This incident can be taken as the political violence based on gender discrimination. So, the feminists from all over the world started to celebrate the day of their assassination as Day on "Violence against Women". Later on it was officially recognized by United Nations and established it as an International Day on elimination of all forms of "Violence against Women".

16 days of activism celebration is more significant unlike other International celebrations since this celebration to end VAW is not limited to a single day. It is also important as a platform being used by women activists all over the world to call for the elimination of all forms of VAW and advocate for women’s right to live in equality. Every year it is celebrated from 25th November till 10th December (International Human Rights Day) by organizing different awareness raising programs. This year also WOREC Nepal is organizing different programs from community level to National level in solidarity to eliminate VAW all over the world like previous years. The main objective of celebrating this activism is to acknowledge and institutionalize the achievements accomplished in the past by organizing different programs from the perspectives of women's liberation and the commitment to end VAW.

 

Present Status:

The primary step to create the environment for the elimination of VAW is the establishment of sustainable peace in the country. And the establishment of sustainable peace is possible only when there is gender friendly constitution in the country. Gender Friendly constitution is not possible without ending the trend of militarization within the political parties and pulling each other's legs. Analyzing the present context, the deadlock condition of the country will not easily end up due to the political instability and irresponsible behavior seen within the political parties. Due to this, the democracy brought by the efforts of thousands of people including mothers who lost their womb, wives who lost their husbands and those who were disabled, is on a verge of collapse now. In such context, speeding up of 16 days campaign to eliminate VAW is imperative in order to make the stakeholders and duty bearers aware, and strengthen the capacity of right holders to be able to claim their rights.

 

In previous year (2011)," 100 days Campaign on Violence against Women for Zero Tolerance" was conducted on the leadership of Women Human Right Defenders in all the 75 districts. The campaign was conducted with two demands i.e. the mechanism to address complaints registered by the victims of violence within 24 hours should be developed and there should be a policy for the "Security of Women Human Rights Defenders". During the campaign on 2068/11/11, Prime Minister Dr. Baburam Bhattarai in inter-ministerial meeting opined that violence on women is an insult to the country; and he directed the Secretary of Ministerial office and Security agency to make short and long term plans to organize campaigns and also directed concerned authorities to address the complaint within 24 hours of registration. Despite of this, women were unable to get proper justice. It is evident that the security personal of high position murdered his wife. Thus it is obvious that women from every sector including housewives, laborers, women in media, women who are involved in politics are also victimized. But still, there is not a single example where the incident of violence against women was addressed within 24 hours. Though Prime Minister personally commanded to respond for the incident it is not being implemented which arise a question on trust and accountability of the government. And we also opined that this situation has arisen due to the militarism existing in political parties, unequal power relationship and patriarchy.

This year, 152 women were killed, 211 women were raped, 12 committed suicide, 23 women were raped by family members and 75 women were alleged as witch.[1] Despite of such increasing number of cases on VAW, there are very rare cases where the victims succeeded to get justice. Such situation is not acceptable for any Nepalese who struggled to establish democracy in Nepal. So, we all should enroll ourselves and request all to participate in the campaign "Establish Peace from our home to world by challenging Militarism".

Referring to the reality of Nepalese society with intrinsic social patriarchal system fueling for gender disparity and gender violence against women, and current political situation in Nepal, this year WOREC Nepal has formulated its slogan as follows : "Peace to end Violence against Women: Constitution for peace building and our Collaboration to make Political Parties Responsible for Constitution making!"So, we request all the Nepalese to show their commitment in our attempt to transform this slogan into reality.

 

Analysis:

Based on study, researches and experiences of women right activists, it can be stated that until and unless there is existence of the trend of militarism and persisting patriarchy nourished by militarism in the ruling government, political parties and other responsible security personals, neither democracy will be strong nor VAW will be eliminated. So, Nepal is in verge of both opportunity as well as challenges today. On one hand with the collective effort of civil society, Human Right Activists, other democratic forces and political parties challenged to eliminate the previously established patriarchal militarism, which creates opportunity to establish the egalitarian society; and on the other hand, the people with traditional and persisting practice of patriarchal militarism might jeopardize the achievements made after long struggle although they have verbal commitment to democracy and social justice. There is increasing risk due to rigidity of political parties, militarist trend and patriarchal concern. This situation is challenging those who are working to eliminate VAW. Internalizing this situation also, women right activists are relentlessly campaigning on "Violence against Women". After the Comprehensive Peace Agreement and commitment to establish peace in the country, the government is also conducting different programs named "Zero Tolerance on Violence against Women". Such programs are reflected as compensatory process; however, this could not bring any significant change in women's life and situation. Obviously, everyone should think seriously about the reason behind this happening.

The women activists through their experiences from community level to national level have found that the "Militarist patriarchal trend" still exists in the mentality of people at all levels and also opined that this is due to the globalization of open market economy. Until and unless the country is liberated in real sense, the political parties free themselves from corruption and become active for the country and people, the change cannot occur. The country will be continuously directed and controlled by different power centre; and the ongoing peace process will never be concluded.

The search of peace would not be possible only through army integration. It will be possible only after the elimination of Militarism trend, by addressing grievances armed conflict and translating consensus of political parties and their honest commitment into practice. It is impossible to address this situation without coordination and pressure for "Agreement between political parties and their commitment to implement the agreement in practice". Thus WOREC Nepal has forwarded the slogan "Peace to end violence against women: Constitution for peace building and our collaboration to make Political Parties Responsible for Constitution making!!. With this slogan, WOREC Nepal will organize different programs during the period of the 16 days activism.

Objectives: The main objectives of the 16 days of activism are as follows:

  • To exert pressure for political commitment to end violence against women.
  • To create awareness among common people for ending violence against women.
  • To launch "Anbeshi" an analytical report on VAW and make concerned stakeholders responsible for ending VAW by presenting the year book as a proof.
  • To mention everyone about the role and importance of Women Human Right Defenders (WHRDs) and to do advocacy for their identity and security.
  • To initiate for the solidarity of civil society to exert pressure for promulgation of constitution and conclude peace process.

  • The basis to continue 100 days campaign on violence against women will be prepared.
  • Opinions from people of different sectors will be collected, which will help to create a favorable environment to pressurize for new constitution making.

बैशाख देखि हाल सम्म (फाल्गुन) ९२ जना महिलाहरुलाई बोक्सीको आरोपमा हिंसा भएको ओरेक नेपालको तथ्याकंले देखाएको  छ । बाहिर नआएका घटनाहरुको संख्या त्यतिकै मात्रामा छ । बोक्सिको आरोप लगाई  भनाभन भएको घटनालाई समाजमा घटना नै नमान्ने स्थिति छ । त्यस्ता घटनाहरु मिलाउन  र ढाकछोप गर्न समाजमा नेतृत्व गरेका अगुवा व्यक्तिहरु र राजनैतिक दलका व्यक्तिहरु नै अग्रसर भएर लागिपरेका छन् भन्ने प्रमाणित गर्ने आधारहरु धेरै छन् ।

समग्रमा भन्नुपर्दा यसरी सामाजिक कुरितीहरु तथा अन्धविश्वासमा आधारित भई नेपाली महिलाहरुलाई बोक्सिको आरोप लगाई मल मुत्र खुवाउँदा, रापिलो धातुले डाम्दा, कालो मोसो दल्दा, बिभिन्न प्रकारले अपमान गर्दा, यातना दिँदा तथा जिउँदै जलाई  ज्यानै सम्म लिंदा पनि किन यहाँ परिवर्तनका लागि ठोस कदम चालिन्न ? यो प्रश्नको जवाफ खोज्नु आवश्यक भएको छ ।

बोक्सी भन्ने आरोप लगाई महिला माथि गरिने हिंसा, अन्धबिश्वास र समाजमा आधारित कुरितीहरुको परिणाम हो ।

बोक्सीको आरोप लागि महिला माथि गरिने विभिन्न प्रकारका अपराधहरु देशमा बढ्दै गैराखेको स्थितिले सामाजिक न्यायमा विश्वास राख्ने हरेक नेपालीलाई आज चिन्तित बनाएको छ । ओरेक नेपालबाट उपलब्ध तथ्यांकलाई मात्र आधार मान्ने हो भने पनि यो बर्ष ९२ वटा घटना  दर्ता भएका छन् । ती मध्ये बहुसंख्यक घटनामा मानव सभ्यता माथि नै प्रश्न उठाउने खालका बिभत्स प्रकारका अपराध अत्याचारहरु गरिएको छ ।

देश राजनीतिक रुपले लोकतान्त्रिक प्रणाली तर्फ रुपान्तरितहुने क्रममा भए पनि यो प्रकृयाले सामाजिक, आर्थिक संरचना, समाजमा जरो गाडेर रहेको बिभेद र अन्धबिश्वास मा आधारित संस्कृतीलाई संबोधन नगरेको स्थितिले यस्ता अपराध गर्ने अपराधिहरुलाई बल पुगेको छ । देशमा स्थापित बिभेद, अन्याय र अन्धविश्वासमा आधारित सामाजिक, साँस्कृतीक कुरीतीहरु अन्त्य गर्ने उद्देश्यलाई मूल मुद्दा बनाई सुरु गरिएको भनिएको १२ बर्षे राजनैतिक हिंसात्मक द्वन्द्व को अन्त्य गरी सुरु गरिएको शान्ति निर्माण प्रकृयामा शान्तिको लाभांस पाउनुपर्ने व्यक्तिहरुलाई शान्ति निर्माण प्रकृयाबाट बाहिरै राखिएको स्थितिले यसलाई मलजल गरेको छ । यो स्थितिको मार सब भन्दा बढी महिलाले खेप्नु परिराखेको स्थिति छ । २०४६ सालमा शुरु गरिएको भनिएको देशको लोकतान्त्रिकरणको प्रकृया, राज्य द्वारा अन्तराष्ट्रिय मानवअधिकारका दस्ताबेजहरुमा हस्ताक्षर गरी जनाएको प्रतिबद्धता, बिभिन्न राजनैतिक पार्टिका महिला संगठनहरु तथा राष्ट्रियदेखि समुदाय स्तरसम्म रहेको महिला समूह, संघ संस्थाहरुका साथै मानव अधिकारकर्मीहरुको संजालहरुले महिला ससक्तिकरणका प्रकृयालाई पु¥याएको योगदानका कारण महिलाहरु भित्र सुरु भएको ससक्तिकरण र हिंसा बिरुद्ध मौनताको संस्कृती अन्त्य गर्ने अठोट अहिले धरापमा परेको छ । देशमा  जरो गाडेर रहेको पितृसत्तात्मक सामाजिक, आर्थिक र सांस्कृतिक संरचनाका कारण उत्पन्न असमान सम्बन्ध जस्ता बिभेदपूर्ण स्थितिलाई अन्त्य गर्ने प्रयास शान्ति निर्माण प्रकृयामा प्राथमिकतामा नपर्नु बरु सत्तालाई जोगाउन गरिएको खेलका कारण उत्पन्न राजनैतिक अस्थिरता, दण्डहिनता, राजनीतिक अपराधीकरणले गर्दा महिलाहरु दोहोरो हिंसाको मारमा परिराखेको यथार्थता आज सबैको सामु छ ।

अहिलेको  स्थिति   

देश राजतन्त्रवाट  लोकतान्त्रिक गणतन्त्रमा रुपान्तरित भएको छ । नयाँ नेपालको खाका कोरिदै गरेको अवस्था छ । तर नेपाली महिलाहरुको अवस्थामा भने खासै परिवर्तन आउन सकेको छैन । अहिले पनि महिलाहरुलाई विभित्र बाहानामा प्रताडित गरिरहेको अवस्था छ । उनीहरु माथि बिभिन्न प्रकारका अपराधहरु भैरहेका छन् । बोक्सीको आरोप लगाई  मलमूत्र खान बाध्य बनाइएको छ । जिउँदै जलाइएको छ । आँखा निकालिएको छ । तातो पन्यूले डामिएको छ । समाज घरबाट निकाला गरिएको छ । तर, यी केही प्रतिनिधि मूलक घटनाका रुपहरु मात्रै हुन् भन्ने हामिले बुमmेका छौं ।  यस्ता धेरै घटनाहरु अमmै बाहिर आएका छैनन् ।  यसरी बाहिर आएका घटनाहरुमा पनि  पिडकले  सजाय पाएका छैनन् । पिडितले न त कानूनी न्याय नै पाएका छन् न त सामाजिक न्याय नै । पिडितहरु आफु माथि भएको अन्यायहरु खप्दै जीवनभर अपहेलित जीवन बिताउन बाध्य बनाइएकाछन् ।

यस्ता व्यबहारहरु कानूनी सामाजिक अपराध हुन्, तर देशमा यस्ता अपराधहरुलाई सम्बोधन गर्ने  उपयुक्त कानूनी आधार छैनन् π  पिडितलाई सहयोग गर्ने सहयोगी संयन्त्रहरु छैनन् । उनीहरु माथि गरिएको अपराधका कारण उनीहरुको जीवन यापन कष्टकर बनेको छ, तर उनीहरुलाई “न्याय पाउनु भनेको आकाशको फल आँखा तरी मर भनेको उखान” मmैं भएको छ । जीवन यापन का लागि क्षतीपूर्ती पाउने अधिकार सुनिश्चित गरिने आधार छैनन् ।

महिला अधिकार मानव अधिकारस्

यस्ता अपराधहरु राज्यले महिलाको मानव अधिकार सुनिश्चित गर्न नसकेको स्थितिबाट उत्पन्न परिणामहरु हुन् । तर यस्ता मुद्दाहरु मानव अधिकारका मुद्दाका रुपमा  स्थापीत हुन सकेका छैनन् ।  यस्ता मुद्दाहरु सम्बोधन गर्ने जिम्मेवारी सरकारको हो ।

सरकारलाई सर्बोच्च अदालतले मिति २०६७ साल जेष्ठ २८ गते बोक्सी प्रथा जस्तो अमानुषिक व्यवहार रोकथाम, नियन्त्रण र सजाय गर्ने प्रभावकारी कानून तर्जुमा गर्न नेपाल सरकारलाई निर्देशनात्मक आदेश जारी गरिसकेको अवस्था छ । त्यसैगरि महिला विरुद्ध भेदभाव उन्मूलन समिति ९ऋभ्म्ब्ध् ऋयmmष्ततभभ० ले सन् २०११ मा नेपालमा महिला हक सुनिश्चितताका लागि सरकारले  गर्नुपर्ने कार्यहरु भनि स्पष्ट रुपले निम्न  सुमmाबहरु दिएका छन् , ती मध्ये केहि सुझाबहरु निम्न अनुसार छन्ः

क) महासन्धीको धारा २ (एफ) र ५ (ए) अनुरुप पितृसत्तात्मक सोंच तथा महिला विरुद्ध हुने भेदभावको प्रचलन उन्मूलन गर्न ठोस लक्ष्य तथा समय तालिका सहित व्यापक रणनीति बिना ढिलाईका साथ अवलम्बन गर ≤

ख) नागरिक समाजका साथै समुदाय र धार्मिक नेताहरुलाई सामेल गरी महिला र पुरुष दुवै लक्षित गरि हानिकारक परम्परा अन्त्य गर्न संचार माध्यमहरु सित सहकार्य गरी महिलाहरुको सकारात्मक, परम्परागत भन्दा भिन्न र भेदभाव रहित चित्रण गर्न र जनचेतना अभिवृद्धि तथा शैक्षिक प्रयास सुदृढिकरणमा जोड दिन ≤  तथा  

ग) हानीकारक सामाजिक अभ्यास सम्बन्धि मस्यौदा कानूनलाइ तुरुन्त लागु गर र यसमा सबैप्रकारका हानीकारक प्रचलन समावेश भएको सुनिश्चित गर तथा विना ढिलाई यस कानुनको पूर्ण कार्यान्वयनको सुनिश्चितताका साथै यसको  प्रभावकारि कार्यान्वयनको लागि अनुगमन गर ≤

त्यसैगरी सन् २०११ मा नै भएको नेपालको मानव अधिकारको बिश्वव्यापि समिक्षा (ग्एच् च्भ्ख्क्ष्भ्ध्) का बखत धेरै देशहरुले नेपाल सरकारलाई महिला हिंसा अन्त्य गर्न जिम्मेवार पहल गर्न सुमmाब दिएकाछन् , राज्य द्वारा त्यसलाई स्वीकारी पहल गर्ने अठोट गरिएको छ । देशका सबै राजनीतिक पार्टिहरुका घोषणात्रहरु मार्फत महिला हिंसा अन्त्य गर्ने प्रतिबद्धता जारी गरिएको छ, तर पनि आज महिला माथि भइराखेको यस्तो जघन्य अपराध किन राष्ट्रिय बहस को मुद्दा बन्न सकेको छैन, यो गम्भिर प्रश्न छ ।

बोक्सी भन्ने आरोप लगाई महिला माथि गरिने हिंसा, अन्धबिश्वास र समाजमा आधारित कुरितीहरुको परिणाम हो । नागरिकहरुको सामाजिक, आर्थिक अधिकार सुनिश्चित नभएको स्थिति तथा महिलालाई दिएको दोस्रो दर्जाको स्थानले यस्ता अन्धविश्वास र अपराधहरुलाई मल जल गर्दछन् । यस्ता अपराध सम्बोधन गर्नका लागि अन्धबिश्वास अन्त्य गर्ने अभियान संचालनका साथै, अन्धविश्वासमा आधारित हिंसा गर्ने व्यक्तिलाई बलियो कानूनी दायरामा ल्याउनु अनिवार्य हुन्छ । यसका लागि संरचनागत परिवर्तन गर्न सरकार तयार हुनपर्दछ । महिलालाई हेर्ने विभेदकारी दृष्टिकोणमा परिवर्तन ल्याउने अभियान चलाउनु आवश्यक हुन्छ । तर दुःख को कुरा यहाँ महिला अधिकार सुनिश्चितताका लागि संवेदनशिल छु भन्ने सरकार समेत बाट यसरी जघन्य अपराध भईराखेको स्थितीमा समेत यस्ता अन्धविश्वासको आधारमा गरिने अपराध अन्त्यका लागि जिम्मेवार काम गरिएको छैन । यसमा थप यस्ता अपराध बिरुद्ध गरिने कार्यमा हुनुपर्ने संबेदनशिलताको ख्यालै नगरी सस्तो लोकप्रियताका लागि गरिने गरिएका घोषणाहरुले के यसरीे समस्याको दिगो समाधान हुन्छ ? के साच्चै सरकार यस्ता अपराध अन्त्य गर्न संबेदनशिल छ ? भन्ने गम्भिर प्रश्न खडा भएको छ । यो स्थितीले यस्ता गम्भिर अपराधहरुका बिरुद्ध सबै नागरिक एकजुट भई उभिनुपर्ने स्थिति आएको छ । यही स्थितिलाई गम्भिरताका साथ लिदैं महिला मानव अधिकार रक्षकहरुको राष्ट्रिय संजाल को संयोजनमा बिभिन्न महिला अधिकार प्रति संबेदनशील संजाल, संस्था, व्यक्तिहरु द्वारा यसरी “बोक्सीक आरोप लगाई महिलाहरु माथि गरिने अपराधका बिरुद्ध ६० दिने अभियान संचालन गर्न गईरहेको छ” ।

 अभियानको प्रमुख उद्देश्यहरु

स्थानीय स्तरदेखि राष्ट्रिय स्तरसम्मका सरोकारवालाहरुलाई  बोक्सीको आरोप लगाई महिला माथि गरिने अपराध बिरुद्ध सचेत बनाउनुको साथै यस्ता अपराधहरु महिलाको मानव अधिकार हनन् हो भन्ने बिषयमा समुदाय तह सम्म सुचना पु¥याउने एवं प्रभावितको न्याय तथा जीवन यापनका आधार सुनिश्चित गराउनका लागि पैरवी गर्ने ।

    बिभिन्न संचार संस्थाहरुको सहयोगमा सुचना प्रसारित, अन्तरवार्ता र अन्तरकृयाहरु

    बोक्सीको आरोप लागी अपराध खप्न बाध्य महिलाहरुका लागि तुरुन्तै न्याय प्राप्त गर्ने संयन्त्रको व्यवस्था
    प्रभावितहरुको सामाजिक, आर्थिक, अधिकार सुनिश्चितता गर्ने प्रभावकारी व्यवस्था
    सरकारी तहबाट बोक्सी अन्धबिश्वास हो, सामाजिक कुरीतीजन्य सोच को परिणाम हो, भन्ने बुमmाउने खालको प्रभावकारी संचार अभियान संचालन ।
